2. Service Description

GHOSTPWA is a SaaS platform that provides tools for creating, customizing, and managing Progressive Web Applications. The Service includes a web-based dashboard, PWA builder, template library, and related infrastructure.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee that the results of using the Service will meet your expectations.

3. Eligibility

The Service is intended for persons aged 18 and older. By using GHOSTPWA, you confirm that you are at least 18 years old. We do not knowingly collect data from persons under 18.

4. Account Registration

To access the Service, you must create an Account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your Account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Neutral Tool Positioning

GHOSTPWA is a software provider. We are not involved in the content, advertising, or traffic generated by your Created PWAs. We do not organize gambling, betting, or financial services. We provide a technological shell — a PWA builder — and bear no responsibility for the content you place within the applications you create.

6. User Responsibilities

You guarantee that:

• You have the legal right to run the traffic and content associated with your Created PWA.
• Your use of the Service complies with all applicable laws, including advertising, consumer protection, and gambling regulations in your target jurisdictions.
• You will not use the Service for phishing, brand impersonation, fraud, or distributing malware.
• You will not use the Service for creating phishing pages, identity theft, fraudulent schemes, distribution of malicious software, infringement of intellectual property rights, or unauthorized use of trademarks or images of public figures.

Violation of these conditions may result in immediate Account suspension without refund. We bear no responsibility for losses arising from misuse of the Service.

7. Third-Party Integrations

As part of the Service, you may independently integrate third-party tracking tools (e.g., Facebook Pixel, TikTok Pixel, Google Analytics) into your Created PWA. GHOSTPWA provides only the technical capability to insert these tags.

GHOSTPWA does not control, access, or process the data collected by these third-party tags. You are solely responsible for configuring these trackers in compliance with applicable laws and the policies of the third-party providers.

8. Payment & Subscriptions

Access to certain features of the Service requires a paid subscription. Payment terms and pricing are displayed on the Service dashboard. All financial transactions are processed by secure third-party Payment Gateways compliant with PCI-DSS standards. We do not store credit card numbers or full payment details.

9. Intellectual Property

All rights to the GHOSTPWA platform, including but not limited to source code, design, trademarks, and documentation, belong to GHOSTPWA. You retain ownership of the content you create using the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, GHOSTPWA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold GHOSTPWA harmless from any claims, liabilities, or damages arising from your use of the Service or your Created PWAs, including any misuse of third-party trackers integrated by you.

12. Geographic Restrictions

While our Service is global, certain advertising networks and legal jurisdictions impose restrictions. We reserve the right to restrict access or services from specific countries if required by compliance policies or local laws. It is your responsibility to ensure your traffic sources comply with geo-targeting rules.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

14. Third-Party Resources

The Service may contain links to third-party sites or resources. We do not control and are not responsible for the content, privacy policies, or practices of such resources. You use them at your own risk.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the dashboard or by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability & Governing Law

If any provision of these Terms is found unenforceable, it shall be modified to the minimum extent necessary to be valid, while the remaining provisions remain in full force.

Any disputes arising in connection with these Terms shall be resolved in accordance with applicable international commercial law.

17. Language Precedence

These Terms are originally written in English. Translations may be provided for convenience. In case of any discrepancy between the English version and any translated version, the English version shall prevail.
